Photo to itemized inventory

Terms of Service

Draft. This document has not yet been reviewed by a lawyer. It describes how Picozy actually works and is published for transparency while review is underway. Sections still open are marked below.

Picozy turns photographs into an itemized inventory with estimated values. It is a starting point for your own records, your accountant, or your insurer — not a professional valuation. These terms explain what you get, what you are responsible for, and what happens to your data.

Draft — not yet in effect

1. These terms

These terms are an agreement between you and the operator of Picozy ("Picozy", "we", "us"). They apply whenever you use the site, upload a photograph, or buy a report.

If you do not agree with them, do not use the service. If you are using Picozy on behalf of a company or other organisation, you confirm you are authorised to accept these terms for it.

Open for legal review

  • Insert the contracting entity, its registered address, and company number. Nothing in the product currently names a legal entity.
  • Confirm whether a click-through acceptance is needed at account creation and at checkout, or whether the existing checkout acknowledgment plus continued-use language is sufficient in the target jurisdictions.

2. What Picozy is, and what it is not

You upload photographs of a room or property. Picozy identifies the furnishings, appliances, decor and fixtures visible in them, and produces an itemized list with an estimated value for each item, split into personal property and building components. You receive the results on screen and as a downloadable PDF.

Picozy is not a valuation, an appraisal, a cost segregation study, an insurance determination, or tax advice, and it is not a substitute for a qualified professional. No physical inspection is performed and nobody visits the property.

The output is a starting point. You are responsible for reviewing it and for any decision you make on the basis of it, including anything you file with a tax authority or submit to an insurer.

3. Estimated values

Every value shown is a generalized figure for an item of the type and quality identified. It is not an assessment of your particular item. It does not reflect condition, age, wear, provenance, brand, rarity, local market conditions, or what the item would actually sell for.

Two identical-looking items in the same photograph will carry the same estimate even if one is damaged and the other is new, because condition is not assessed at all.

Where an item could not be identified confidently, or could only be valued as a general estimate rather than a specific match, the report flags it for review and reports its value separately from the rest. Those flags are part of the product, not a defect in it.

4. Personal property and building components

Reports separate movable personal property and furnishings from building components such as cabinetry, countertops, flooring, and plumbing or electrical fixtures.

This separation is descriptive. Building components are structural, and Picozy does not determine whether any item is eligible for reclassification, depreciation, or any particular treatment. Suggested asset classes shown in a report are illustrative and must be confirmed by a CPA or cost segregation engineer before use.

5. Your photographs

You keep ownership of everything you upload. You give us permission to store and process your photographs only to produce, deliver and re-deliver your report, and for the retention period described below.

You confirm you have the right to upload each photograph, and that doing so does not infringe anyone else's rights or breach anyone's privacy. Do not upload photographs of a property you have no connection to, and do not upload images whose main subject is a person.

We do not sell your photographs, publish them, or use them to advertise the service.

Open for legal review

  • Confirm the licence grant is drawn narrowly enough for its purpose but broadly enough to cover storage, sub-processing, and regeneration of a report.
  • Decide whether an explicit representation about not uploading images of identifiable people is wanted, and how it interacts with biometric and likeness statutes in the target markets.

6. The free sample

You can upload one photograph without an account or payment. The sample is deliberately limited: only the first few lines are shown in full, the remaining detail and all monetary totals are withheld, and the PDF is watermarked.

Nothing in a free sample is invented to fill the gap. Withheld figures are withheld, never substituted with made-up numbers.

7. Buying a report

Reports are sold as a one-time purchase priced per photograph. The price for your batch is shown before you pay. Payment is handled by Stripe; we never receive or store your card details.

You do not need an account to buy a report. We ask for an email address so we can send you the download link — for a guest purchase, that link is the only route back to your report.

Photographs are analysed after payment is confirmed. A report is usually ready within a few minutes; you can close the page while it finishes and use the emailed link when it arrives.

Open for legal review

  • Set out refund terms. The commercial intent is that a report is a digital good delivered on completion, but statutory cancellation rights for digital content (notably the UK/EU 14-day right and its express-consent waiver) need to be addressed if selling into those markets.
  • Confirm tax handling — whether prices are inclusive or exclusive, and whether Stripe Tax is being relied on for VAT/GST and US sales tax.

8. Extended storage

Extended storage is a separate, recurring subscription tied to an account. It keeps your reports and the photographs behind them available for as long as it is active, instead of the default 30 days.

It renews automatically until cancelled, and you can cancel at any time. Cancelling does not delete your data immediately: a 30-day period runs from the cancellation date, after which the data is deleted as normal.

Extended storage is a storage service only. It does not include new reports, and buying it does not change anything about reports you have already purchased other than how long they are kept.

Open for legal review

  • Confirm auto-renewal disclosure and cancellation requirements — US state automatic-renewal laws (California in particular) impose specific pre-purchase disclosure, acknowledgment and cancellation-mechanism obligations.
  • Confirm whether partial-period refunds are offered on cancellation, or whether access simply continues to the end of the paid period.

9. How long we keep your data

Photographs and generated reports are deleted 30 days after upload.

If an active extended-storage subscription is attached to the account that owns them, they are kept for as long as that subscription runs.

If that subscription is cancelled or lapses, a 30-day period runs from the cancellation date, and the data is then deleted.

Deletion is real and permanent. The photographs, the generated PDF and the underlying record are removed, and we cannot restore a report after it has been deleted. Download anything you want to keep.

10. Accounts

An account is optional and is offered after purchase. It exists so you can find and re-download past reports and hold an extended-storage subscription.

Signing in works by emailed link rather than a password. Anyone with access to your email account can therefore sign in as you; keep it secure. Sign-in links expire shortly after they are sent and can only be used once.

When you first sign in, reports you bought as a guest using the same email address are attached to your account automatically.

11. Acceptable use

Do not use Picozy to break the law, to infringe anyone's rights, or to upload content you have no right to upload.

Do not attempt to disrupt the service, bypass its limits, scrape it, or use automated means to access it beyond ordinary use of the site.

We may suspend or refuse service where these terms are being breached.

12. Our content

The site, the software behind it, and the format and presentation of the reports it produces are ours or our licensors'.

The report generated from your photographs is yours to use, keep, and share — including with your accountant, insurer, or adviser. You may not resell Picozy reports as a service of your own or use the service to build a competing product.

13. Availability

We aim to keep Picozy available and working, but we do not promise uninterrupted service. Maintenance, third-party outages and faults happen.

If a report you paid for cannot be produced because of a fault on our side, tell us and we will put it right.

Open for legal review

  • Decide whether "put it right" should be a defined remedy — regeneration, credit, or refund — and whether it is expressed as the sole and exclusive remedy.

14. Disclaimers

Picozy is provided as it is. Beyond what these terms say expressly, we make no promises about the service — in particular, none about the accuracy, completeness or fitness for any purpose of any identification, estimated value, classification or suggested asset class in a report.

Nothing in these terms limits any liability that cannot lawfully be limited.

Open for legal review

  • Draft the operative warranty disclaimer, including the conspicuousness requirements that apply to disclaimers of implied warranties under UCC §2-316 in the US.
  • Preserve non-excludable consumer rights in each target market. Blanket "as is" language is unenforceable and can itself be a regulatory problem under UK/EU consumer law and the Australian Consumer Law.

15. Limitation of liability

The commercial intent is that our liability arising out of the service is limited to the amount you paid for the report the claim relates to, and that we are not liable for indirect or consequential loss — including tax outcomes, penalties, denied or underpaid insurance claims, or decisions taken in reliance on estimated values.

Open for legal review

  • This section states intent only and is not yet operative drafting.
  • The exposure to size is reliance: a report costs a few tens of dollars and may be used to support a cost segregation position or an insurance claim worth several orders of magnitude more. Confirm whether a purchase-price cap is defensible for that risk profile, and whether insurance should sit behind it.
  • Address carve-outs, non-excludable liabilities, and how the cap interacts with the disclaimers above.

16. Indemnity

The commercial intent is that you are responsible for claims arising from photographs you had no right to upload, and from your own use of a report.

Open for legal review

  • This section states intent only and is not yet operative drafting. Confirm whether an indemnity is appropriate at all in a consumer-facing product, or whether it should apply only to business users.

17. Changes

We may change the service and these terms. If a change materially affects your rights, we will give notice before it takes effect — by email where we have your address, and on the site.

Changes do not apply retroactively to a report you have already bought.

Open for legal review

  • Set the notice period, and confirm the mechanism satisfies unilateral-variation requirements for subscription customers.

18. Ending your use

You can stop using Picozy at any time, cancel a subscription from your account, or ask us to delete your data.

We may suspend or end access where these terms are breached, or where we are required to.

19. Governing law and disputes

The law and the courts that apply to these terms have not yet been fixed.

Open for legal review

  • Choose governing law and forum, and confirm they survive against consumers — mandatory consumer-protection rules in the customer's home jurisdiction often override a choice-of-law clause.
  • Decide on arbitration and any class-action waiver. If adopted, check enforceability and the required opt-out mechanics in each target market.

20. Contacting us

Use the contact form at /contact for questions about these terms, a report, billing, or anything else. We reply to the address you give us.

Open for legal review

  • Add a registered postal address and a formal notice address. Several jurisdictions require a physical address for consumer contracts, and a web form alone will not satisfy a contractual notice provision.
